1. Scope, B2B focus and acceptance

1.1 These terms of use apply to every visit, consultation and use of the Website.

1.2 The Website is primarily aimed at professional users (B2B). Where the Website is nevertheless visited or used by consumers, these terms of use do not affect their mandatory consumer rights and only apply insofar as compatible with such mandatory law.

1.3 By visiting or using the Website, you accept these terms of use. If you do not agree, we ask you not to (further) use the Website.

2. Purpose of the Website – information and no offer

2.1 The Website has an informational and promotional character.

2.2 Content on the Website (including cases, references, blogs, insights, downloads) does not constitute a legally binding offer and does not create a contractual commitment unless expressly stated otherwise and confirmed in writing.

2.3 For certain downloads (such as whitepapers or templates), a specific licence or explanation may apply that is displayed with the relevant download; in case of difference with these terms of use, that specific licence prevails for the use of the relevant download.

3.1 Veyron strives for current and accurate information but cannot guarantee that all content is always complete, correct or up-to-date.

3.2 Veyron may modify, supplement or remove the content of the Website at any time without prior notice.

3.3 Veyron does not guarantee that the Website operates uninterrupted, error-free or virus-free. You remain responsible for appropriate security of your device and network.

4. Intellectual property and usage licence

4.1 All rights (including copyrights, database rights, trademarks, trade names, logos, layout, texts, images, videos, code) to or in connection with the Website belong to Veyron or its licensors.

4.2 You receive a limited, non-exclusive, non-transferable permission to consult the Website and the content available thereon for your own, internal use within your organisation, excluding republication or external commercial exploitation.

4.3 Without prior written permission from Veyron, it is prohibited to copy, reproduce, distribute, publicly communicate, rework, sell, exploit or use (parts of) the Website for derivative works, except where mandatory law provides otherwise or where Veyron explicitly explains this differently for specific content (e.g. a download).

4.4 It is prohibited to remove or modify trademark or source attributions.

5. Permitted and prohibited use (Acceptable Use)

5.1 You undertake to use the Website in a manner that:

• is lawful and does not infringe third-party rights (including intellectual property, privacy and personal data);
• does not harm the operation, security and availability of the Website.

5.2 It is prohibited to:

• use the Website for unlawful, misleading, harmful or fraudulent purposes;
• distribute or attempt to inject malware, scripts or other code;
• (attempt) unauthorised access, scanning, penetration, "scraping", harvesting, reverse engineering, or circumventing security measures;

6.1 The Website may contain links to websites or services of third parties. Veyron does not control these and is not responsible for their content, availability, security or policy.

6.2 Following such links is at your own risk. The terms of use and privacy/cookie policies of those third parties apply.

7. Cookies, analytics and privacy

7.1 Veyron processes personal data in accordance with its Privacy Policy and uses cookies/similar technologies in accordance with the Cookie Policy. These are available via the 'Privacy Policy' and 'Cookie Policy' links at the bottom of the Website.

7.2 Where required, non-essential cookies (such as analytics/marketing) are only placed after consent via the cookie banner or equivalent settings.

8. Liability

8.1 To the extent legally permitted, Veyron is not liable for any damage arising from or related to:

• the use or inability to use the Website;
• inaccuracies, incompleteness or outdated information on the Website;
• disruptions, errors, delays, viruses or other harmful components, including those caused by third parties;
• decisions you make based on website information.

8.2 To the extent liability cannot be excluded under mandatory law, it is limited to the minimum permitted by applicable law. Nothing in these terms of use excludes or limits any liability for intentional misconduct or gross negligence by Veyron, for bodily injury or death caused by its fault, or for other cases where liability limitations are not permitted under mandatory law (including mandatory consumer rights, if applicable).

8.3 To the extent legally permitted, Veyron is not liable for indirect damage (such as consequential damage, loss of profit, reputational damage, loss of data).

9. Indemnification

9.1 To the extent legally permitted, you indemnify Veyron (and its directors, employees, suppliers) against third-party claims arising from your unlawful or prohibited use of the Website, or from an infringement by you of third-party rights.

10. Amendments to these terms of use

10.1 Veyron may amend these terms of use at any time. The most recent version is on the Website with indication of date/version.

10.2 Your continued use of the Website after publication of amendments constitutes acceptance of the amended terms.

11. Applicable law, competent courts and language

11.1 These terms of use are governed by Belgian law.

11.2 Disputes belong, to the extent legally permitted, to the exclusive jurisdiction of the competent courts of (division) Kortrijk, without prejudice to mandatory jurisdiction rules that may apply to consumers and other protected parties.

11.3 These terms of use are drafted in Dutch. If translations are available, in case of conflict the Dutch version prevails.

12. Relationship with Terms & Conditions and (service) agreements

12.1 These terms of use exclusively govern the use of the Website. For the provision of services, quotations, projects or other contractual arrangements, the Terms & Conditions of Veyron and/or the applicable written agreement with you apply.

12.2 In case of conflict between these terms of use and such an agreement, that agreement prevails for the relevant services.
